A few months back, I drafted a blog entry concerning SB 35, which was enacted to streamline the incredibly time-consuming entitlement and environmental review process for certain developments in California. In that March 16th blog post, I had referenced a pending project in Berkeley where the developer had invoked SB 35 in an effort to obtain an expedited approval. As the link below describes, a few weeks ago the City of Berkeley rejected the application of SB 35 to the developer’s pending land use action, though the City slightly left the door open that the project may be subject to SB 35 pending receipt of additional information from the developer. Stay tuned as SB 35 has now been invoked in two other contemplated Bay Area developments and the greater real estate development industry in California will be following the resolution of this situation in Berkeley closely.
